Terms of Service
Effective date: 25 September 2026
1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Aylin Albay ("we", "us", or "our"), an individual developer located in the United Kingdom, regarding your access to and use of the Highlyt mobile application and related web services (https://highlyt-app.web.app).
By downloading, installing, accessing, or using Highlyt, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the application.
2. The Highlyt Service
Highlyt is a mobile application tool designed to help users explore YouTube videos through features such as automated transcripts, AI-assisted video summaries, interactive Q&A, chapter maps, and key highlights.
Highlyt is an independent application and does not claim ownership over third-party YouTube videos, titles, or transcript content.
3. Accounts and Authentication
You may create an account using supported authentication methods, including Google Sign-In or Sign in with Apple. You are responsible for maintaining the confidentiality of your authentication credentials and for all activities that occur under your account. You agree to notify us immediately at studioeightdev@gmail.com if you suspect any unauthorized access to your account.
4. YouTube API Services Compliance
Highlyt uses YouTube API Services to retrieve public video details and support features within the application.
- By using features in Highlyt powered by YouTube API Services, you agree to be bound by the YouTube Terms of Service.
- Rights in YouTube videos, thumbnails, channel materials, and other third-party content remain with YouTube and/or the applicable content owners or rights holders. Highlyt does not acquire ownership of YouTube or third-party content by retrieving or processing it.
- Highlyt is not affiliated with, endorsed by, or operated by YouTube or Google LLC.
5. Acceptable Use Policy
You agree not to use Highlyt for any unlawful purpose or in any manner that violates these Terms. Specifically, you agree not to:
- Use Highlyt in any way that breaches applicable local, national, or international laws or regulations.
- Attempt to bypass, disable, or tamper with security controls, rate limits, or access controls.
- Attempt to gain unauthorized access to our servers, database systems, or API endpoints.
- Use automated scrapers, bots, or extraction scripts to harvest data from the service.
- Infringe the intellectual property rights or privacy rights of any third party.
- Use the service in a manner contrary to YouTube's terms, policies, or developer guidelines.
6. AI-Generated Output Disclaimer
Highlyt utilizes generative artificial intelligence (Google Gemini API) to produce summaries, answers to questions, chapters, and key highlights based on video transcripts.
- AI-generated content is produced automatically and may occasionally contain errors, inaccuracies, or omissions.
- Outputs are provided for informational and educational purposes only and should not be relied upon as professional legal, financial, medical, or technical advice.
- You should independently verify critical factual information before taking action based on AI outputs.
7. Intellectual Property
The Highlyt software, branding, interface, and original materials are protected by applicable intellectual-property laws. These Terms do not transfer ownership of Highlyt materials or third-party materials to you.
Rights in third-party content, trademarks, and other materials remain with their respective owners or rights holders. Your own questions and prompts remain yours, subject to any rights needed to operate the service.
8. Subscriptions and Highlyt Pro
Highlyt offers optional paid subscription tiers (such as Highlyt Pro) providing expanded video analysis limits and premium features.
- In-App Purchases: All subscription purchases are processed directly by the Apple App Store or Google Play Store. Pricing, billing frequency, and store renewal terms are presented prior to purchase.
- Auto-Renewal & Cancellation: Subscriptions may renew automatically in accordance with the terms of the app store through which they were purchased. You can manage or cancel a subscription through that store, subject to the timing, billing, and cancellation rules shown by the relevant store.
- Subscription Management: You must manage or cancel active subscriptions through the store account (Apple ID or Google Account) where you made the original purchase.
1. Deleting your Highlyt account does NOT automatically cancel an active Apple App Store or Google Play subscription. You must cancel your subscription directly through your store account.
2. Canceling a subscription does NOT delete your Highlyt user account or saved video history.
9. Account Termination and Deletion
You may terminate your account and request permanent deletion of your data at any time by visiting our Delete Account page or contacting studioeightdev@gmail.com.
We reserve the right to suspend or terminate your access to Highlyt without prior notice if you violate these Terms, engage in fraudulent activity, or misuse our service or APIs.
10. Service Availability and Modifications
We strive to maintain high service availability, but Highlyt relies on third-party providers including YouTube API Services, Google Gemini, Supabase, and store platforms. We do not guarantee uninterrupted uptime or error-free operation. We reserve the right to update, modify, or discontinue features of Highlyt at any time.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Highlyt is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded or limited under the laws of England and Wales or mandatory consumer protection law.
12. Governing Law and Jurisdiction
These Terms, their subject matter, and their formation are governed by the laws of England and Wales.
Subject to any mandatory rights you have under applicable consumer protection law in your country of residence, you and Aylin Albay agree that the courts of England and Wales will have jurisdiction over any dispute or claim arising out of or in connection with these Terms.
